IMPORTANT DISCLAIMER & WAIVER OF LIABILITY

Inspiring Children Foundation (“ICF”) is a Nevada nonprofit organization whose mission is to transform lives through a whole human approach to physical, social, emotional, and mental health. ICF provides non-clinical, peer-based mentoring, youth development programming, and community-based support focused on personal growth, life skills, and overall well-being.

Non-Clinical Services

ICF provides an inspirational space where peers can connect to each other, discuss their lives, grow, and educate oneself. Participants may share personal experiences that have not been vetted and ICF does not monitor or endorse all peer interactions. Staff share advice and perspective based on their personal, lived experience where applicable.

ICF does not provide medical care, mental health diagnosis, psychotherapy, or clinical treatment through its nonprofit programs. ICF does not diagnose medical or mental health conditions, prescribe medication, or provide licensed therapeutic services within its foundation programming.

Any information, discussions, tools, activities, content, or materials provided through ICF programs, website, staff, volunteers, facilitators, speakers, or participants are for informational, educational, and peer-support purposes only. These resources are not intended to be, and should not be relied upon as, medical, psychological, or psychiatric advice, diagnosis, or treatment.

Participation in ICF programs does not constitute participation in clinical care and does not establish a therapist-client, physician-patient, or any other licensed professional relationship.

Separate Clinical Services

ICF owns and operates a wholly owned subsidiary called Inspiring Wellness Treatment and Management Services. Inspiring Wellness Treatment and Management Services provides clinical services such as psychotherapy and counseling to individuals in accordance with applicable licensing and regulatory requirements. This clinical entity is legally and operationally distinct from ICF’s nonprofit programs and is maintained as a separate organization for purposes of licensing, regulatory compliance, and billing, including insurance where applicable.

ICF may contract with or refer to independent providers of clinical, medical, or psychological services to individuals involved in our programming. Providers operate independently of ICF during provision of any clinical, medical, or psychological services. Engagement with these providers is independent and separate from ICF. Youth and families voluntarily choose to use these services and may use any provider of their choice. ICF is not responsible for any advice, information, treatment, or decisions made by these independent providers.

Participation in ICF programs does not constitute participation in clinical care and does not establish a therapist-client, physician-patient, or any other licensed professional relationship.

No Professional Advice or Relationship

All interactions within ICF programs, including but not limited to communications with staff, mentors, facilitators, or other participants, are informational and/or educational in nature and based on peer support, lived experience, and personal perspective. Such interactions do not constitute professional advice and must not be relied upon in place of consultation with licensed professionals.

ICF strongly encourages all participants to seek evaluation, diagnosis, and treatment from qualified, licensed healthcare providers, including physicians, psychologists, psychiatrists, or other licensed professionals, for any physical, emotional, or mental health concerns.

Participants are solely responsible for evaluating the accuracy, completeness, and applicability of any information obtained through ICF programs before relying on it.

Assumption of Risk and Voluntary Participation

Participation in activities may involve general physical or environmental risks, including the possibility of injury, illness, or other unforeseen events associated with in-person or virtual engagement.

You acknowledge and understand that participation may involve inherent risks, including but not limited to:

  • Exposure to sensitive or emotionally challenging topics, including discussions related to stress, trauma, mental health, relationships, or personal adversity

  • Emotional discomfort, distress, or triggering of past experiences

  • Receipt of opinions, perspectives, or advice from peers that may be incomplete, inaccurate, or not appropriate for your specific circumstances

  • Misinterpretation or misuse of information shared within the program

  • Interpersonal conflict or misunderstandings with other participants, mentors, or facilitators

  • Variability in outcomes, including the possibility that participation may not result in improved well-being and may, in some cases, lead to increased emotional discomfort

ICF does not control, verify, or guarantee the accuracy, appropriateness, or safety of statements made by participants or other non-licensed individuals within its programs.

Participation in ICF programs, activities, events, and services is voluntary. By participating, you acknowledge that you understand the nature of ICF’s non-clinical services and assume full responsibility for your participation.

You further acknowledge that you are solely responsible for your own decisions, actions, and well-being, including any decisions made based on information or experiences obtained through ICF.

By participating, you acknowledge that you have been informed of these risks and voluntarily accept them.

Release and Waiver of Liability

To the fullest extent permitted by Nevada law, you hereby release, waive, discharge, and hold harmless Inspiring Children Foundation, its affiliated entities, and their respective directors, officers, employees, contractors, volunteers, partners, and agents from any and all claims, liabilities, damages, losses, or expenses, whether direct or indirect, arising out of or related to:

  • Participation in ICF programs, or activities

  • Reliance on any information, content, or interactions within ICF

  • Any physical, emotional, or mental health outcomes

  • Any actions taken or not taken based on ICF programs or materials

This waiver includes, without limitation, claims based on negligence to the extent permitted by law. Aligned with Nevada Revised Statute, this waiver excludes gross negligence and/or willful misconduct.

No Guarantee of Outcomes

ICF does not guarantee any specific outcomes related to personal growth, mental health, academic achievement, or life results. Individual results will vary.

Crisis and Emergency Services

ICF programs are not designed to provide crisis intervention, emergency services, or acute mental health care. Some ICF programs rely on asynchronous communication methods (e.g., texting, e-mail, message boards). ICF staff are not trained or equipped to provide crisis intervention or emergency response services. ICF does not guarantee the availability, timeliness, or effectiveness of any response to participant distress.

If you or someone you know is experiencing a mental health crisis, including thoughts of self-harm or harm to others, you should immediately:

  • Call or text the Suicide & Crisis Lifeline at 988

  • Call 911

  • Go to the nearest emergency room

Mandatory Reporting Requirements

ICF is committed to providing a supportive and respectful environment. However, confidentiality within ICF programs is limited and cannot be guaranteed.

You acknowledge and understand that:

  • Communications within ICF programs, including group discussions and peer interactions, are not confidential and may be observed or shared by other participants

  • ICF staff, volunteers, mentors, and facilitators may be required by law to report certain information to appropriate authorities

To the extent required by applicable law, ICF personnel may be mandated reporters and may be obligated to disclose information, including but not limited to:

  • Suspected abuse or neglect of a minor or vulnerable individual

  • Threats of harm to self or others

  • Situations involving potential danger, illegal activity, or risk of serious harm

In such circumstances, ICF may report information to appropriate authorities without prior notice.

No Warranties

All content, programs, services, and materials provided by ICF are offered on an “as is” and “as available” basis without warranties of any kind, express or implied, including but not limited to accuracy, completeness, reliability, or fitness for a particular purpose.

Third-Party Content

ICF may reference or provide access to third-party content, resources, or websites. ICF does not endorse, control, or guarantee the accuracy of such third-party information and is not responsible for any reliance on it.

Severability

If any provision of this Disclaimer and Waiver of Liability is found to be invalid, unlawful, or unenforceable under applicable law, that provision shall be deemed modified to the minimum extent necessary to make it enforceable, or, if modification is not possible, severed from this Disclaimer. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.

Acknowledgment & Agreement

By accessing ICF’s website, participating in its programs, or engaging with its content in any way, you acknowledge that you have read, understand, and agree to this Disclaimer and Waiver of Liability.

I am the parent or legal guardian of the minor participant and consent to their participation in ICF programs. I acknowledge that I have read and understand this Disclaimer and Waiver of Liability and fully agree to its terms on behalf of myself and the minor permitted by law.

You further acknowledge that you have had the opportunity to seek independent legal, medical, and professional advice before participating.
